7 Principles of the US Constitution

Limited Government

• Governmental powers are defined, finite, and specifically granted by a constitution. Article 1: Congress controls trade with foreign nations, but cannot tax exports or give special treatment to one state. Article 1: Congress has sole power to tax.

• Although majority rule determines what government does, certain minority and individual rights constrain what the majority, and in turn the government, may do.

• The government acts on the behalf of its citizens.

• Certain individual rights are fundamental and may not be waived.

• Government exists to serve its citizens and ensure their rights.

• Rational people should be left alone as much as possible.

• Constitutional foundation — Articles I, II, and III in particular, and the Bill of Rights (especially the 9th and 10th Amendments).

Republicanism

• A philosophy of representative democracy in which citizens select representatives to speak and act on their behalf.

• Reflects the principles of popular sovereignty, political equality, and majority rule (with minority and individual rights).

• Popular sovereignty recognizes that all political authority originates from the people.

• Political equality recognizes that all people have an equal right to participate in choosing representatives and deciding issues.

• The selection of representatives is usually decided in democratic (i.e. free, fair, open, and competitive) elections.

• Constitutional foundation — Articles I, II, and IV (Section 4).

Checks and Balances

• Specific constitutional limitations that one branch of government can impose on the actions of another. Article 1: Congress can pass a law over a presidential veto with a 2/3 vote.

• Also, requirement that certain actions of one branch must be endorsed by another in order to be valid. Article 2: President appoints judges, Congress must approve.

• Designed to limit the ability of leaders to abuse power by ensuring that “ambition will counter ambition.” Article 1: Congress is elected by the people. Congress will be elected every two years.

• Requires government leaders to cooperate in order to accomplish key tasks.

• The court’s power of judicial review has become an additional check on the other two branches.

Federalism

• A constitutional division of powers between a central government and its state governments. Article 4: States have the right to make laws for their state.

• Powers exercised by the national government are either delegated, implied, or shared. Powers exercised by the states are reserved or shared. Certain powers are denied to government.

• Undelegated powers are reserved to the people (or the states).

• Intended to keep government as close to the people as possible.

• The national governmental powers have accrued over the years.

• Constitutional foundation — Article IV (Interstate Relations), Article V (Amendments), Article VI (Supremacy Clause).

Separation of Powers

• Refers to the constitutional allocation of powers among three branches of government according to their general function.

• Allows each branch a degree of independence. Article 3: Judges serve a term of life. Judges salaries can not be reduced.

• Includes a divided legislature (upper and lower houses) and court system (trial courts and appeals courts).

• Designed to limit the potential for tyranny (corruption) on the part of any one all-powerful branch, or the potential for any one segment of society to exert too much influence on government.

• Constitutional foundation — Articles I, II, and III.

Popular Sovereignty

• The belief that all political authority originates with the people. Article 1: Congress is elected.

• Supports the concept of the “social contract” in which people voluntarily join together to create government and submit to it.

• Suggests that if a government fails to protect the rights of its citizens, then the social contract can be “renegotiated.”

• Constitutional foundation — “We, the People…,” the 9th Amendment, and the constitutional amendment provisions.

Individual Rights

• Belief that all people enjoy certain specific liberties and protections solely because they are part of a society. Amendment 3: during peace, no quartering of soldiers without permission; during war, only under lawful rules. Amendment 6: Trial by jury guaranteed.

• Whether rights are “natural” or “endowed by our Creator,” they must be legally defined. However, rights do not have to be listed in the Constitution in order to be valid (9th Amendment).

• In the U.S. political system, the courts are the final arbiters of the meaning, scope, and delineation of individual rights.

• “Life, liberty, and property,” “due process of law,” and “equal protection of the law” — 5th and 14th Amendments.

• The Bill of Rights defines the majority of U.S. rights. Amendments 1-10.

• Rights often come into conflict, and therefore cannot be absolute.

• 13th Amendment ends slavery

• 14th Amendment makes freed slaves citizens of the US

• 15th Amendment guarantees voting rights to ALL citizens

When the British fired in the early dawn

The War of Independence had begun,

The die was cast, the rebel flag unfurled.

And on to Concord marched the foe

To seize the arsenal there you know,

Waking folks searching all around

Till our militia stopped them in their tracks,

At the old North Bridge we turned them back

And chased those Redcoats back to Boston town.

And the shot heard 'round the world

Was the start of the Revolution.

The Minute Men were ready, on the move.

Take your powder, and take your gun.

Report to General Washington.

Hurry men, there's not an hour to lose!

Now, at famous Bunker Hill,

Even though we lost, it was quite a thrill,

The rebel Colonel Prescott proved he was wise;

Outnumbered and low on ammunition

As the British stormed his position

He said, "Hold your fire till you see the whites of their eyes!"

Though the next few years were rough,

General Washington's men proved they were tough,

Those hungry, ragged boys would not be beat.

One night they crossed the Delaware,

Surprised the Hessians in their lair,

And at Valley Forge they just bundled up their feet!

And the shot heard 'round the world

Was the start of the Revolution.

The Minute Men were ready, on the move.

Take your blanket, and take your son.

Report to General Washington.

We've got our rights and now it's time to prove.

Well, they showed such determination

That they won the admiration

Of countries across the sea like France and Spain,

Who loaned the colonies ships and guns

And put the British on the run

And the Continental Army on its feet again.

And though they lost some battles too,

The Americans swore they'd see it through,

Their raiding parties kept up, hit and run.

At Yorktown the British could not retreat,

Bottled up by Washington and the French Fleet,

Cornwallis surrendered and finally we had won!

From the shot heard 'round the world

To the end of the Revolution

The continental rabble took the day

And the father of our country

Beat the British there at Yorktown

And brought freedom to you and me and the U.S.A.!

God bless America, Let Freedom Ring!
